Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fitoa, the studio-management software owned and operated by MakeAndUpdate ("Fitoa", "we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Fitoa.

The service

Fitoa provides software that lets fitness studios manage classes, bookings, members, messaging, and payments, and lets members book and manage their activity. Features may change over time as we improve the product.

Accounts

You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for activity that occurs under your account. You must be old enough to form a binding contract in your jurisdiction to use Fitoa. Studio administrators are responsible for the members and staff they add.

Payments and subscriptions

Payments are processed by Stripe and are subject to Stripe's terms. Where a studio collects payments from its members, that studio is the merchant of record for those transactions and sets its own pricing, packages, and refund and cancellation policies. Fees for a studio's own Fitoa subscription are billed on the plan selected and, unless stated otherwise, are non-refundable except as required by law.

Acceptable use

You agree not to:

• use Fitoa for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorized access to the service, other accounts, or its systems;
• interfere with or disrupt the integrity or performance of the service;
• upload malicious code or use the service to send spam or unlawful messages.

Your content and data

You retain ownership of the content and data you submit. You grant us a limited license to host and process it solely to provide the service. Our handling of personal information is described in our Privacy Policy.

Third-party services

Fitoa integrates with third-party services such as Stripe and Google. Your use of those services is subject to their own terms and policies, and we are not responsible for them.

Termination

You may stop using Fitoa at any time. We may suspend or terminate access if you violate these Terms or to protect the service. On termination, your right to use the service ends; certain provisions (such as disclaimers and limitations of liability) survive.

Use of AI

Artificial intelligence was used in the development of this product, and the service includes AI-assisted features — for example suggested actions, written drafts, summaries and insights. AI-generated output may be inaccurate, incomplete or out of date, and it is not professional, legal, financial, medical or tax advice.

You are responsible for reviewing AI-generated output before relying on it, sending it to your members, or using it to make a business decision. Do not rely on it as the sole basis for any decision that affects a person's health, safety, money or legal rights. Where an AI feature drafts a message on your behalf, you remain the sender and are responsible for its contents.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Fitoa and MakeAndUpdate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the service.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
